Westminster Council operates three property licensing schemes covering nearly the entire borough. Selective licensing has been live since November 24, 2025 — covering 15 of 18 wards across two designations. If you rent out property in Westminster, you almost certainly need a licence.

Westminster selective licensing has been in force since November 24, 2025. The council can issue civil penalties of up to £40,000 (effective 1 May 2026) without any prior warning. Unlicensed landlords also cannot serve Section 21 eviction notices. If you haven’t applied yet, do so immediately.

Designation 2 (anti-social behaviour): Bayswater, Hyde Park, Lancaster Gate, Marylebone, Pimlico North, Regent's Park, West End. Only Pimlico South, St James's, and Vincent Square are excluded.
What is the difference between the two designations?
Designation 1 covers 8 wards with the worst housing conditions. Designation 2 covers 7 wards with anti-social behaviour concerns. The licensing requirements and fees are the same for both — the designations reflect different grounds under the Housing Act 2004.

Yes. Westminster operates borough-wide additional HMO licensing covering HMOs with 3 or more unrelated sharers. This scheme has been live since August 30, 2021 and runs for 5 years. Fees are £1,540 plus £68 per letting over 5.
What about mandatory HMO licensing?
Mandatory HMO licensing applies nationally to HMOs with 5 or more occupants from 2 or more households. In Westminster, the fee is £1,540 plus £68 per additional property for 6 or more. As of November 2024, Westminster had 272 mandatory HMO licences and an estimated 425 unlicensed properties.
What happens if I don’t get a licence?
Operating without a required licence can result in a civil penalty of up to £40,000 (effective 1 May 2026) without any prior warning, criminal prosecution with unlimited fines, Rent Repayment Orders for up to 12 months’ rent, and you cannot serve a valid Section 21 eviction notice while unlicensed.
Can I still rent out my property while waiting for my licence?
Yes. Westminster has confirmed that licences do not need to be approved before a property can be rented. You can apply and continue letting while your application is being processed.
