Why do I need proof of service?
If a local authority investigates, the burden is on the landlord to show the Information Sheet was provided. A dated Certificate of Service — ideally signed by the tenant — is your evidence against a penalty of up to £7,000 per tenancy.
Is this certificate a legal requirement?
No. The legal requirement is to serve the Information Sheet itself. This certificate is a record-keeping aid to evidence that you did so. Keep it with your tenancy file.
What counts as valid service?
Giving the tenant a hard copy by hand or post, or sending the Information Sheet PDF as an attachment to an email or text message. Sending only a link to the PDF does not count.
Do I need one per tenant?
Each named tenant should receive the Information Sheet. You can list all tenants for one property on a single certificate, but keep separate proof where tenants are on separate tenancy agreements (e.g. some HMOs).
